Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Flatandflatmates India is a social platform available for members to transact in real estate.

These are the terms and conditions & privacy policy governing your use of the groups and page of Flatandflatmates India.

By accessing Flatandflatmates India page and any of its groups either through the website or Facebook or any other electronic device, you acknowledge, accept and agree to be strictly governed by the following terms of the APL.
You further agree and understand that we do not endorse, market or promote any of the listings, postings or information.

You agree that you are solely responsible and accountable for the Information that you provide in any form whatsoever on connected groups or page and that we act as a mere platform for its online distribution and publication.

  1. RECOMMENDATION
    While interacting with other users on our page or group(s), with respect to any listing, posting or information, we strongly encourage you to exercise reasonable diligence as you would in traditional off line channels and practice judgment and common sense before committing to or complete intended transaction or exchange of information.

    We recommend that you read and watch our Announcement Section posts and videos before doing any activity on our page or any group.
  2. PURPOSE
    Our aim is to help keep the market transparent keeping in mind the large base of students:
    • To rent a habitable accommodation in budget
    • To read the customer reviews before making a selection
  3. POST APPROVAL
    Posts are approved on the basis of past group activity of the User, content of the post, pattern of spamming activity of the User related to:
    Tenancy & Flatmate;
    Available property for rent or sale, Purchase requirement;
    Legal Services;
    Awareness related to Real Estate Market, Laws and Customer Reviews;
    PG Owners and related domestic services.
    Urgent Blood Donation or Medical Help It is at the sole discretion of the Admin to approve or reject a post without submitting reason to the User.
  4. DUPLICATE LISTING
    Duplicate Ad listings are not allowed. Any ad posted more than once in a week with the same content or Title in the same city would be considered as a Duplicate Ad. All duplicate ads would be deleted and User blocked if the problem persists.
  5. CUSTOMER REVIEW
    Posts related to the experience of the tenancy including Property Review; Landlord Review; Tenant Review; Society Review & Issues faced strictly related including but not limited to deposit, rent, maintenance, amenities; proportional rent hike;
    renovation and other relative issues with two-fold aim:
    • Increase the quality of service provided to a Tenant;
    • Ensure the safety of a Landlord’s property
  6. BLACKLIST PROPERTIES
    A branch of Customer Review, Flatandflatmates India platform is an open platform where users are able to tag certain property related post as Blacklist Properties.

    For approval:
    • User must attach photos of the property
    • User must define deficiency in property/related service/transaction with landlord or related parties with proof.
  7. VERIFICATION PROCEDURE OF CUSTOMER REVIEWS & POSTS USING
    THE TAG OF ‘BLACKLIST PROPERTIES’
    Flatandflatmates India holds no responsibility to verify the post before approval. This service is voluntary and may stop anytime without informing the members. This act is out of good faith and only as a measure from our volunteer based Flatandflatmates India SOS Community formed from within the group members. Since we do not receive any payment for this from group members, we do not hold any accountability for the content of the approved post.

    • We message once the author of the post. If we receive no response, we do not approve the post.
    • On receiving response from the author of the post, we ask for proof against their claims and ask them to remove all unsupported statements from the post.
    • We call once the other party/Service Provider. If the call is not attended, we do not call again and the post is approved.
  8. MODIFICATION OF CONTENT – POST APPROVAL
    Post once approved is not reviewed by the admin or Flatandflatmates India including Customer Reviews or Blacklist Properties. Members need to be vigilante and not take information given in the group by any User at its face value.
    User cannot modify content without express permission of admin including getting the language and content reviewed before using it in the post for modification. On report of such a post, the User will be blocked from the group on going against or behind the admin’s knowledge related to: modification, editing, omission or addition to the post after approval.
  9. REPORT FEATURE & MISUSE OF REPORT FEATURE
    You agree to inform us only using the report feature, if you come across any listing or posting that is offensive or violates APL. Misuse of report feature to get genuine content removed for frivolous or personal gains or wasting the time of the admin will lead to the reporting User’s account being blocked.
  10. AWARENESS VIDEOS
    The videos uploaded on Flatandflatmates India by the admin are solely for the purpose of awareness and a social effort to aware, caution and guide new or young members to manoeuvre the prevailing floor nuances. We do not intend to hurt any sentiments, religious or otherwise or defame any person or business. The names taken in the videos or announcements are solely for the purpose of awareness, as provided in customer review and taken to be truth after conducting primary verification of the same. The information presented in the videos are based on digital research of existing laws or information provided by the members. Flat and Flatmates or any of its
    associated persons including the admin hold no accountability or responsibility of the veracity of the information accumulated from the internet or members from our virtual platform. We encourage you to conduct primary research on the information provided in the videos to verify its contents as your own diligence.
  11. INTERMEDIARY LIABILITY AND CYBER DEFAMATION
    Flatandflatmates India does not initiate the transmission of any content, nor does it select the receiver(s) from the members, of such content or modifies any content. Flatandflatmates India conducts due diligence, and has ‘notice and take down’ procedure using only the ‘Report’ feature for any content found to be misleading or
    not true. Any other method used to ‘report’ including admin’s private messenger is not considered. Any complaints sent to Flatandflatmates India page inbox may take up to a week to be resolved. Section 79 of the IT Act provides that an intermediary is not liable for third party information, data, links hosted on its platform. An intermediary shall only be liable if it initiates the transmission of such defamatory content, selects the receiver of such content or modifies such content, neither of which is done by Flatandflatmates India .
    Although, the medium of committing this act in the physical and digital world are different, the law of defamation applies the same.
    The liability regarding cyber defamation in India is on the author of the defamatory material online.
  12. LIABILITY
    You agree not to hold Flatandflatmates India or any of its admins, officers, employees, agents responsible or accountable for any listing, postings or information and nor shall we, admins, our officers, employees or agents be liable for any misuse, illegal activity or third party content as most postings, listings or information are generated by various users directly and we do not have any role in the creation, publication or distribution of the posting, listing or information, nor are we in a position to have editorial control over the substance or content contained in the listings, postings, or information, save and except to the extent provided in sec 3 above. You understand and agree that we do not guarantee the accuracy or legitimacy of any listing, posting, information by other users. You further agree that we are not liable for any loss of money, goodwill, or reputation, or any special, indirect, or
    consequential damages arising out of your use of the page or group(s) or as a result of any communication, transaction, sale, purchase with other users of the the page or group(s).
